Terms and conditions of sale

These terms govern orders for Clavhello keyboards and accessories placed on quote. The French version prevails in case of discrepancy.

1. Seller

Clavhello products are sold by MONSIEUR ANDREAS VONFELD, sole proprietor (trade name: Vonfeld Digital), Chemin des Vignes Blanches, 83670 Tavernes, France, SIRET 93987272700010, VAT FR77939872727 (“the Seller”). Contact: contact form.

2. Scope

These terms apply to any order placed with the Seller by a consumer or business customer (“the Customer”). The Customer accepts them when accepting their quote. The applicable terms are those in force on the date the quote is accepted.

3. Products

The Seller offers mechanical keyboards and accessories made to order, in particular according to the configuration chosen by the Customer in the configurator.

The visuals, colours and sounds of the configurator are for guidance only: a screen never perfectly reproduces a real colour or material, and switch sounds are simulations. Such differences do not constitute a lack of conformity.

4. Quote request and conclusion of the contract

The Customer designs their keyboard in the configurator and sends a quote request from their account. This request is free and does not commit the Customer.

The Seller reviews the request and sends the Customer a quote stating the product description, its price, applicable taxes, delivery costs, the estimated production and delivery time and the validity period of the quote. The Seller may decline a request, in particular if the configuration or design cannot be made.

The contract is concluded when the Customer accepts the quote by making the payment.

5. Prices and payment

Prices are stated in euros on the quote. Payment is made in full upon acceptance of the quote, through the secure payment link sent by the Seller. Card details are processed directly by the payment provider and are never stored by the Seller.

Production starts once full payment has been received.

6. Production and delivery

Each product is made to order by the Seller’s manufacturing partners and then shipped to the address provided by the Customer. The production and delivery time, usually several weeks, is stated on the quote. The Customer is kept informed by email of the progress and shipment of their order.

For deliveries outside the European Union, import duties and taxes may be payable by the Customer under the rules of the destination country.

If delivery is late beyond the stated time, a consumer Customer has the rights provided by French consumer law, including terminating the contract after asking the Seller to deliver within a reasonable additional period.

The Customer should check the parcel on receipt and report any damage to the carrier and the Seller as soon as possible.

7. Right of withdrawal

Under Article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. Keyboards and accessories designed in the configurator, or personalised at the Customer’s request, therefore cannot be returned under the right of withdrawal.

For non-personalised products sold as is in the shop, a consumer Customer has 14 days from receipt to withdraw without giving any reason, by sending an unambiguous statement to the Seller through the contact form. The product must be returned within 14 days of that statement, return costs being borne by the Customer. The Seller refunds the amounts paid, including initial standard delivery costs, within 14 days of the withdrawal; it may withhold the refund until it has received the product or proof of its dispatch.

8. Legal warranties

A consumer Customer benefits from the legal guarantee of conformity under Articles L217-3 et seq. of the French Consumer Code for two years from delivery: in the event of a lack of conformity, they may obtain repair or replacement of the product, or failing that a price reduction or termination of the contract.

They also benefit from the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

For any claim, the Customer contacts the Seller through the contact form describing the defect, with photos where possible.

9. Designs provided by the Customer

A Customer who uploads a design warrants that they hold the rights needed to use it and that it does not infringe any third-party rights. The Seller may refuse any unlawful, infringing or offensive design.

10. Personal data

The Customer’s data is processed in accordance with the privacy policy.

11. Complaints and mediation

Any complaint may be sent to the Seller through the contact form.

If no amicable solution is found, a consumer Customer may refer the matter free of charge to a consumer mediator, whose details are provided on request.

12. Governing law

These terms are governed by French law, without depriving a consumer Customer of the protection of the mandatory provisions of the law of their country of residence. Disputes fall under the jurisdiction of the courts designated by the applicable rules of procedure.
